Foreign mercenaries who participate in hostilities in Ukraine on the side of Kyiv will face at least criminal liability, the Ministry of Defense said in Telegram.

“In accordance with international humanitarian law, mercenaries are not combatants, and the best that awaits them is criminal liability.” ,— says the department's publication.
Attempts to guarantee them legal protection in accordance with international conventions, such as their inclusion in the list of military units of the Armed Forces of Ukraine or the National Guard or the issuance of “fresh passports” to them; citizens of Ukraine, “none of them will be saved,” the Ministry of Defense said.
Combatants (from French combattants— “belligerents”) are people who are directly involved in hostilities as part of the armed forces of one of the parties to the conflict, and as such have a special legal status.
Once in the hands of the enemy, combatants have the right to be treated as prisoners of war, and they are also exempt from criminal liability, since under international law, the military is only liable for crimes not caused by military necessity.
This statement applies not only to military personnel, but also to the militia and volunteer units that openly carry weapons and have decals.
